1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Wyrmscale LARP website and associated online services ("the Platform") operated by Wyrmscale LARP ("Wyrmscale", "we", "us", "our"), a volunteer-run live-action roleplay community organisation based in Auckland, New Zealand.

By accessing our website or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use our services. These Terms are governed by the laws of New Zealand, including the Contract and Commercial Law Act 2017 and the Fair Trading Act 1986.

2. Eligibility

You must be at least 16 years of age to create an account on the Platform. Users who are under 18 years of age must have the consent of a parent or legal guardian to register.

By registering, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and truthful.

3. Account Registration and Security

To access most features of our Platform, you must register for an account by providing your email address and a password. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorised use of your account by contacting us via the contact email listed on our website.
  • Keeping your account information accurate and up to date.

We reserve the right to disable any account at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms.

4. Acceptable Use

You agree to use our Platform only for lawful purposes and in a manner consistent with our Code of Conduct.

You agree not to:

  • Violate any applicable New Zealand law or regulation.
  • Harass, threaten, bully, or cause harm to other users or participants.
  • Post content that is discriminatory, defamatory, obscene, or that otherwise contravenes our Code of Conduct.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorised access to any part of our systems, accounts, or data.
  • Use automated tools, bots, or scripts to scrape, crawl, or otherwise interact with our Platform without our written permission.
  • Engage in any conduct that interferes with, disrupts, or imposes an unreasonable burden on our infrastructure or services.
  • Share your account credentials with any other person.

5. User Content

Users retain ownership of any content they submit to the Platform.

By submitting content such as characters, messages, or backstories ("User Content"), you grant Wyrmscale LARP a non-exclusive, royalty-free licence to host, display, and distribute that content for the purpose of operating the Platform and promoting the game. You also:

  • Represent and warrant that your content does not infringe the intellectual property, privacy, or other rights of any third party.
  • Acknowledge that our GM team may use your character backstory and other submitted content in the course of running the game.

We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms, our Code of Conduct, or any applicable law.

6. Intellectual Property

The Wyrmscale name, branding, setting, lore, artwork, website design, and all other content created by Wyrmscale LARP are protected by copyright and other intellectual property laws. All rights are reserved.

Nothing in these Terms grants you any licence to reproduce, distribute, or create derivative works from our intellectual property, except as strictly necessary to use our Platform for its intended purpose.

7. Platform Availability

The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation.

We do not warrant that our Platform will be free from viruses or other harmful components, and we may suspend or withdraw access at any time for maintenance or other operational reasons.

8. Limitation of Liability

To the fullest extent permitted by New Zealand law, Wyrmscale LARP, its organisers, volunteers, and game masters shall not be liable for any indirect or consequential loss arising from your use of the Platform, including loss of data or loss of profits.

Where our liability cannot be excluded by law, our total liability to you in respect of any claim shall not exceed the total amount you have paid to Wyrmscale LARP in the 12 months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Wyrmscale LARP and its organisers, volunteers, and game masters from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of the rights of any third party.

10. Termination

We reserve the right to suspend or terminate access to the Platform at any time where these Terms are breached. Where possible, we will endeavour to communicate the reasons for any such decision.

You may close your account at any time by contacting us via the contact email listed on our website. Termination does not affect any rights or obligations that have arisen prior to termination.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.

For disputes involving amounts within the Disputes Tribunal's jurisdiction, you may also be eligible to file a claim through the New Zealand Disputes Tribunal.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms. Where changes are material, we will endeavour to notify registered users by email or by prominent notice on our website.
